Welcome to OpenMarket. These Terms are the rules for using our website, iOS app, and Android app. By creating an account or using the Service, you agree to these Terms and our Privacy Policy. We’ve tried to keep this readable — but it’s still a legal agreement, so please read it.
The deal
Using OpenMarket means you accept these Terms and our Privacy Policy. If you don’t agree, please don’t use the Service.
We may update these Terms occasionally. We’ll post the new version here with a fresh date. If the change is significant, we’ll try to tell you. Using OpenMarket after an update means you accept the new Terms, unless the law says we need your explicit OK.
Quick glossary
You — the person or business using OpenMarket.
Content — everything we show you: software, product listings, images, and text.
Your content — what you send us: chat messages, profile info, support tickets, delivery notes.
Premium — paid subscription with extra features.
Purchase agent — we help you buy items from overseas or hard-to-reach sources, with quotes and fees shown before you pay.
Third-party seller — Amazon, Rakuten, AliExpress, or another merchant — not OpenMarket itself.
Who can use OpenMarket
You need to be at least 18, or old enough to sign a contract where you live. If you’re younger, a parent or guardian must accept these Terms for you.
You’re responsible for following local laws — including import rules, taxes, and consumer regulations.
We may block access in certain countries or on certain devices if we have to.
Your account
Sign up with email or Google. Give us real, up-to-date information.
Keep your password private. Anything that happens under your account is your responsibility until you tell us it’s been compromised.
We may suspend or close accounts that break these Terms, look fraudulent, or put others at risk.
Some features need a verified email first.
What OpenMarket offers
OpenMarket is an AI shopping assistant and marketplace hub. Depending on your platform and plan, you can:
• chat to search products across multiple stores;
• save wishlists and view order history;
• check out eligible items on OpenMarket;
• request purchase-agent quotes and tracking;
• subscribe to Premium;
• join referral programs; and
• get help from our support team.
Features can differ between web, iOS, and Android, and we may add, change, or remove features over time — though we won’t ignore your active Premium subscription rights.
AI shopping assistant
Our AI is here to help you discover products — not to give professional advice. Suggestions can be wrong about price, specs, compatibility, or availability.
Always verify details on the product page or with the seller before you pay. Don’t rely on the AI for medical, legal, financial, or safety-critical decisions.
Products from other stores
We show listings from Amazon, Rakuten, AliExpress, OpenMarket, and elsewhere. Information comes from those sources and may change without warning.
Unless we clearly say we’re the seller, we don’t make or ship third-party products. Tapping an external link takes you off OpenMarket — that site’s rules apply.
Buying on OpenMarket
When you checkout with us, you agree to pay the price shown — including tax and shipping displayed before you confirm.
We can refuse or cancel orders (for example if something is out of stock or looks fraudulent), and we’ll tell you when the law requires it.
For physical goods, delivery terms are shown at checkout.
Purchase agent service
Purchase agent is a white-glove option: you request an item, we quote fees and shipping, you approve, then we buy and ship on your behalf.
You’re responsible for customs, import restrictions, and local taxes at the destination. Delivery dates are estimates, not guarantees.
If the price or availability changes a lot, we’ll ask before proceeding.
Premium subscription
Premium renews automatically through Stripe until you cancel. Price and billing period are shown when you subscribe.
Cancel anytime in the app or via Stripe’s portal. Cancellation stops future charges; it usually doesn’t refund the current period unless the law or app store rules say otherwise.
We may change Premium features or pricing with notice where required. If a new price doesn’t work for you, cancel before it kicks in.
Payments & refunds
Stripe processes all payments under Stripe’s terms. Keep your payment method valid.
Failed payments may pause Premium or delay orders. Unless the law or our checkout screen says otherwise, fees are non-refundable once charged. Chargebacks may lead to account suspension.
Referrals
Sometimes we run referral rewards. Rules are shown in the app and can change. Don’t game the system with fake accounts or self-referrals — we may revoke rewards and close accounts for abuse.
Play fair
Please don’t:
• break the law or harass others;
• hack, scrape, or overload our systems;
• upload malware or content you don’t have rights to;
• skip payments or Premium paywalls;
• use the AI to generate harmful or illegal content; or
• resell OpenMarket without our written permission.
We may investigate misuse and work with authorities when necessary.
What you send us
You own your chat messages and other content you submit. You give us permission to use them only to run OpenMarket — reply to you, improve the service, and keep things secure.
Don’t submit anything illegal or that infringes someone else’s rights. We can remove content that breaks these Terms.
Our brand & software
OpenMarket’s name, logo, code, and design belong to us or our licensors. You get a personal, non-commercial license to use the Service — not to copy, resell, or reverse-engineer it, except where the law allows.
Downloading from Apple or Google
If you got OpenMarket from the App Store or Google Play:
• these Terms are between you and OpenMarket, not Apple or Google;
• Apple and Google aren’t responsible for the app or its content;
• you must follow their store rules too; and
• they’re third-party beneficiaries of certain clauses in their developer agreements.
Updates may come through the store or in-app. Some features need the latest version.
No perfect guarantees
OpenMarket is provided “as is.” We work hard to keep it reliable, but we can’t promise it will always be error-free, uninterrupted, or that every product detail will be accurate.
Use your own judgment — especially with AI suggestions and third-party listings.
Limits on our liability
To the fullest extent the law allows, OpenMarket isn’t liable for indirect damages — lost profits, lost data, or business interruption — arising from your use of the Service.
Our total liability for any claim is capped at the greater of (a) what you paid us in the 12 months before the claim, or (b) USD $100.
Some countries don’t allow these limits; where that’s true, we limit liability only as much as the law permits.
If you cause us harm
If your use of OpenMarket, your content, or your violation of these Terms causes claims against us, you agree to cover reasonable costs (including legal fees) we incur defending ourselves.
Ending your access
You can stop using OpenMarket anytime. Ask us via Contact to close your account.
We can suspend or terminate access if you break these Terms or if we must for legal or security reasons.
Sections that naturally should survive (like disclaimers and liability limits) still apply after termination.
Law & disputes
These Terms are governed by the laws of Japan, except where mandatory consumer laws in your home country say otherwise.
Disputes generally go to the courts in Tokyo, Japan — unless your local law gives you the right to sue at home.
Before filing in court, please contact us and give us 30 days to try to resolve things informally.
Changes to these Terms
We’ll post updates here. If you keep using OpenMarket after a change, that counts as acceptance — unless we need your explicit consent under the law. Don’t agree? Cancel Premium and stop using the Service.
